Late yesterday , the 5th Circuit Court of Appeals issued an opinion to vacate the Department of Labor’s Fiduciary Rule in its entirety. However, the Fiduciary Rule will remain in effect for at least 45 days as the DOL decides on whether to appeal the ruling.
